Any use of this web site provided by EPASS International Limited and/or its affiliates ("EPASS International"), "EPASS International Web Site", is subject to these Terms of Use. These Terms of Use may be amended, modified or replaced by other terms and conditions. With log-in, or where a log-in is not required in accessing or using the EPASS International Web Site, these Terms of Use are accepted in their then-current version.
Services
a. This EPASS International Web Site contains specific information and software, as well as - as the case may be - related documentation, for viewing or downloading.
b. EPASS International may stop the operation of the EPASS International Web Site in full or in part at any time. Due to the nature of internet and computer systems, EPASS International cannot accept any liability for the continuous availability of the EPASS International Web Site.
Registration and Password
a. Some pages of the EPASS International Web Site may be password protected. In the interest of safety and security of business transactions, only registered Users may access said pages. EPASS International reserves the right to deny registration to any User. EPASS International particularly reserves the right to determine accessibility to certain sites subject to registration. EPASS International is entitled, at any time and without obligation to give reasons, to deny the User the right to access password-protected areas by blocking its User Data (as defined below), in particular if the User
- uses false data for the purpose of registration;
- violates these Terms of Use or neglects its duty of care with regard to User Data; violates any applicable laws in the access to or use of the EPASS International Web Site; or
- does not use the EPASS International Web Site for a stipulated period to be reviewed from time to time in EPASS International’s sole discretion.
b. For registration the User shall give accurate information and, where such information changes over time, up-date such information (to the extent possible: online) without undue delay. The User shall ensure that both its e-mail address and its mailing address, as supplied to EPASS International, are current at all times.
c. Upon registration the User will be provided with an access code, comprising a User ID and a password ("User Data"). On first access the User shall promptly change the password received from EPASS International into a password known only to the User. User Data allows the User to view or change its data or, as applicable, and to withdraw its consent to data processing.
d. The User shall ensure that User Data is not accessible by third parties and is liable for all transactions and other activities carried out under its User Data. At the end of each online session, the User shall log-off from password protected websites. If and to the extent the User becomes aware that third parties are misusing its User Data the User shall notify EPASS International thereof without undue delay in writing, or, as the case may be, by e-mail.
e. After receipt of the notice under paragraph 3 d., EPASS International will deny access to password-protected areas under such User Data. Access by the User will only be possible again upon the User's application to EPASS International or upon new registration.
f. The User may at any time request termination of its registration in writing, provided that the deletion will not violate the proper performance of contractual relationships. In such an event EPASS International will remove all user data and other stored personally identifiable data of the User as soon as these data is no longer needed.
Other Liability, Viruses
a. The liability of EPASS International for defects in relation to quality and title shall be determined in accordance with the provisions of these Terms of Use. Any further liability of EPASS International is excluded unless required by law, or in cases of willful misconduct, gross negligence, personal injury or death, failure to meet guaranteed characteristics, fraudulent concealment of a defect or in case of breach of fundamental contractual obligations. Damages in case of breach of fundamental contractual obligations are limited to contract-typical, foreseeable damage if there is no willful misconduct or gross negligence.
b. Although EPASS International makes every endeavor to keep the EPASS International Web Site free from viruses, EPASS International cannot make any guarantee that it is virus-free. The User shall, for its own protection, take the necessary steps to ensure appropriate security measures and shall utilize a virus scanner before downloading any information, software or documentation.
Online Toolkits and Calculators
EPASS International Limited ("EPASS International") provides the calculators for convenience. EPASS International gives no warranty, express or implied, as to the accuracy, reliability and completeness of any information, formulae or calculations provided through the use of the calculators and does not accept any liability for loss or damage of whatsoever nature, which may be attributable to the reliance on and use of the calculators.
Data Privacy and Protection
For collection, use and processing of personally identifiable data of the User of the EPASS International Web Site, EPASS International shall comply with applicable laws on data privacy protection and the EPASS International Web Site Data Protection Privacy Policy, which is available per hyperlink on the EPASS International Web Site and/or on www.epassinternational.com.
